Welcome to Flowsery! These Terms of Service govern your use of our privacy-first web analytics platform. By using our Service, you're agreeing to these terms. If that doesn't work for you, please don't use the Service.

2. Definitions

3. Acceptance of Terms

By creating an account or using our Service, you're confirming you've read and understood these Terms and our Privacy Policy. You're also confirming you're legally able to agree to them. If you're signing up on behalf of a company, you're confirming you have the authority to do so.

4. Account Registration and Security

To use certain features, you'll need to create an account. When you do, please:

You're responsible for everything that happens in your account. We can't be held liable if something goes wrong because you didn't protect your credentials.

5. Subscription and Payment

We have different subscription plans to choose from. When you subscribe:

You're authorizing us to charge your payment method for the subscription

Your subscription renews automatically unless you cancel before the renewal date

We might change our prices, but we'll give existing subscribers 30 days' notice

All displayed prices include applicable taxes (VAT or similar)

Refunds work according to our refund and withdrawal policy (see Section 6)

We can suspend or close your account if payments aren't made

By subscribing, you expressly consent to the immediate provision of digital content and services, and acknowledge that you lose your right of withdrawal for any digital content that has been fully delivered or consumed, in accordance with Article 16(m) of the EU Consumer Rights Directive (2011/83/EU)

6. Refund and Withdrawal Policy

In accordance with the EU Consumer Rights Directive (2011/83/EU), here's how refunds and withdrawal rights work:

Right of Withdrawal for Subscriptions: As an EU consumer, you have the right to withdraw from your subscription within 14 days of your initial purchase, without giving any reason

The 14-day withdrawal period applies only to your initial subscription purchase. Subscription renewals are not eligible for withdrawal, as continued use of the Service after the renewal date constitutes acceptance of the renewed subscription

Digital Content:

Our analytics service β€” including real-time dashboards, tracking data, reports, and API access β€” constitutes digital content within the meaning of Article 16(m) of the Consumer Rights Directive. By subscribing, you expressly consent to the immediate performance of the service and acknowledge that you lose your right of withdrawal once the service has been delivered

Subscription periods during which the service was available are considered fully performed digital services. No refund will be issued for periods during which you had access to the analytics service

For unused portions of your subscription, you may request a pro-rata refund within the 14-day withdrawal period. The refund amount will be calculated based on the remaining time in your billing period

Approved refunds will be processed within 14 business days and returned to your original payment method

We reserve the right to deny refund requests that violate our Terms of Service or show evidence of abuse

7. Acceptable Use

Use our Service responsibly and legally. That means you won't:

Break any laws or infringe on anyone's rights

Upload viruses, malware, or anything harmful

Try to access our systems without permission

Mess with the Service or disrupt it for others

Send spam or unwanted messages

Pretend to be someone you're not

Use bots or automated tools to access the Service without our okay

Reverse engineer or tamper with our code

8. Intellectual Property Rights

Everything in the Service β€” the software, design, content, trademarks β€” belongs to us or our licensors. It's protected by intellectual property laws.

These Terms give you a limited license to use the Service for your business. This license is non-exclusive, can't be transferred, and we can revoke it.

You own the content you create. By using the Service, you're letting us use your content to run and improve the platform β€” but only for that purpose.

Don't copy, modify, sell, or distribute our Service without written permission from us.

9. Data Protection and Privacy

We handle your personal data according to our Privacy Policy and data protection laws like GDPR.

You have rights over your data β€” you can access it, correct it, delete it, move it, or object to how we use it.

We take security seriously and use proper measures to protect your data. That said, no system is 100% secure.

If there's a data breach, we'll let you know as required by law.

You are solely responsible for the websites you track with Flowsery and ensuring your use complies with applicable laws and regulations.

11. Termination

You can close your account anytime through your settings or by contacting us.

We can suspend or close your account if you break these Terms, do something fraudulent, or for other reasons we deem necessary.

When your account is closed:

You'll immediately lose access to the Service

We might keep some of your data if the law requires it or we need it for legitimate reasons

Prepaid subscription fees are subject to the 14-day withdrawal policy described in Section 6

Some parts of these Terms (like payment obligations) will still apply even after termination

12. Disclaimers and Warranties

THE SERVICE COMES "AS IS" AND "AS AVAILABLE." WE DON'T MAKE ANY PROMISES ABOUT IT.

WE DISCLAIM ALL WARRANTIES β€” WHETHER IT'LL WORK FOR YOUR NEEDS, BE ERROR-FREE, OR ANYTHING ELSE.

We can't promise the Service will always be available, bug-free, or completely secure.

If something goes wrong with your system or you lose data while using the Service, that's on you, not us.

13. Limitation of Liability

TO THE EXTENT THE LAW ALLOWS, WE'RE NOT LIABLE FOR INDIRECT DAMAGES, LOST PROFITS, LOST DATA, OR OTHER CONSEQUENTIAL DAMAGES FROM YOUR USE OF THE SERVICE.

IF WE ARE LIABLE FOR SOMETHING, THE MAXIMUM WE'LL PAY IS WHAT YOU PAID US IN THE LAST 12 MONTHS.

Some places don't allow these kinds of limitations, so they might not apply to you.

14. Indemnification

If someone makes a claim against us because of something you did β€” like how you used the Service, breaking these Terms, violating someone's rights, or your content β€” you agree to cover us for any costs, including legal fees.

15. Modifications to Terms

We can update these Terms. When we do, we'll post the new version and update the date at the top.

If you keep using the Service after we make changes, that means you accept them.

If you don't like the new Terms, stop using the Service and close your account.

16. Governing Law and Dispute Resolution

These Terms are governed by Polish law.

Any disputes will be handled in the courts of GdaΕ„sk, Poland.

If you're a consumer in the EU, you might also be able to bring a case in your own country's courts.

17. General Provisions

These Terms and our Privacy Policy make up the full agreement between us.

If part of these Terms isn't valid or enforceable, the rest still applies.

If we don't enforce something right away, that doesn't mean we're giving up the right to enforce it later.

You can't transfer your account or these Terms to someone else without our permission. We can transfer them if needed.

These Terms don't create any partnership, employment, or agency relationship between us.
